By January 31, all 1099-Gs will be mailed out to individuals who had claimed Unemployment Insurance (UI) benefits in the previous calendar year. The department urges claimants to review the address listed on their claim account for accuracy. In addition to receiving a hard copy in the mail, in January you will be able to log into the UI Tax & Claims System and view your 1099G. You can also print additional copies if needed.

To view your 1099-G online, log into the Unemployment Insurance Tax & Claims System ( https://www.jobs.state.nm.us), from your claimant homepage select 'View Correspondence' from the menu on the left-hand side of the screen.

The New Mexico Department of Workforce Solutions cannot return any withheld taxes to you. Only the federal or state government can return those to you as part of your income tax refund, if you are eligible for a refund.

No. The total amount of unemployment benefits you received is taxable to the State of New Mexico under New Mexico State Tax Law. While you may be eligible to exclude a portion of your unemployment benefits on your federal tax return, there is no exclusion in New Mexico.

If you receive a 1099-G from the New Mexico Department of Workforce Solutions (NMDWS) but did not file for unemployment benefits and believe you may be a victim of fraud or identity theft, follow these steps:

  • File a Fraud Affidavit form with NMDWS at https://www.dws.state.nm.us/identitytheft. Report all information you may have about the fraudulent claim including Claimant ID number and first and last name.
  • If you receive a debit card, do not activate the card. You may destroy this card and/or upon your fraud report to NMDWS we will have the card closed for you. After reporting to NMDWS you may also call the customer service phone number for Way2Go Card at 1-844-309-5657 or report fraud and request for it to be closed.
  • Protect your Identity. You may create an account with the Federal Trade Commission (FTC) at www.identitytheft.gov. Through FTC an individual can create an Identity Theft Report and Identity Theft Dispute Letter. If individuals are not able to file online they may contact the Identity Theft Resource Center toll-free at 888-400-5530 to report the identity theft.

The information on the 1099-G tax form is provided as follows:

  • Box 1: Unemployment Compensation - This box includes the dollar amount paid in benefits to you during the calendar year.
  • Box 2: Adjustments - This box includes cash payments and income tax refunds used to pay back overpaid benefits.
  • Box 4: Federal Income Tax Withheld - This box includes the total amount of federal income taxes withheld, if you designated any, from your benefits during the calendar year. 
  • Box 11: State Income Tax Withheld - This box includes the total amount of state income taxes withheld from your benefits for the calendar year. (We do not offer to withhold NM State Tax, only Federal)
  • Box 10b: NM State Identification no. - This box is not required by the IRS to file, so there is no number provided.
