The Labor Relations Division (LRD) enforces payment of wages, minimum wage, and overtime labor laws under the Wage Pay Act and the Minimum Wage Act. The LRD also enforces the payment of prevailing wages to laborers and mechanics under the Public Works Minimum Wage Act. The LRD takes claims for unpaid wages from employees and ex-employees and conducts investigations to determine if wages are owed. The LRD also provides seminars and materials to employer and employee groups on the compliance requirements of the various state labor laws.

Wage Claim Forms

The entire wage claim form needs to be completed as best as possible. For translation, or if you need assistance completing the wage claim form, please call the LRD at one of the numbers listed below, Monday through Friday from 8:00 a.m. to 5:00 p.m. A wage claim form can be submitted by mail, fax, or email to wage.claimssubmiss@dws.nm.gov, or in person at any Labor Relations Division office listed below. Fax machines are available for your use free of charge at any New Mexico Workforce Connection Center.

Investigations Manual

The LRD Investigations Manual contains detailed information about the procedures and laws LRD applies to investigate wage claims and take enforcement action.

La División de Relaciones Laborales (Labor Relations Division, LRD) impone las leyes de pago de salario, salario mínimo, y de trabajo a horas extra bajo la Ley de Pago de Salarios (Wage Pay Act) y la Ley de Salario Mínimo (Minimum Wage Act). La LRD también impone el pago del salario predominante para trabajadores y mecánicos bajo la Ley del Salario Mínimo sobre Obras Públicas (Public Works Minimum Wage Act). La LRD recibe reclamos sobre salarios no-pagados de parte de empleados y exempleados y lleva a cabo investigaciones para determinar si se deben los salarios.
