About the Child Labor Section

The Child Labor Section enforces the Child Labor Act and investigates possible violations concerning minors. This Section issues and monitors work permits and age certificates issued by the schools to assure compliance. In addition, the section is responsible for notifying school officials of applicable laws and making presentations to students and employers. The Child Labor Section continues to work in partnership with the USDOL to expand the leverage of its enforcement and education initiatives. Education serves to promote voluntary compliance by informing employers, educators, young workers, and their parents about the child labor laws so that they may make informed decisions about when and where young workers should work.

Employers are generally subject to both state child labor laws and the federal child labor provisions of the Fair Labor Standards Act (FLSA), 29 U.S. C. 212(c), and the FLSA regulations at 29 CFR part 570. Certain provisions of New Mexico state law may be less restrictive than federal law, and employers covered by the FLSA that only follow a less restrictive provision of New Mexico state law will be in violation of federal law, See 29 U.S.C. 218 (a). Employment of Children In The Entertainment Industry

The New Mexico Department of Workforce Solutions enforces rules for employing and protecting child performers in the entertainment industry, including motion pictures, theatrical, radio, and television productions. The rules require employers to follow educational and safety requirements stated in rules 11.1.4.1-15 NMAC and the statutes 50-6-1 to 50-6-19 NMSA 1978 Comp.

The employer is responsible for obtaining a Pre-Authorization Certificate for any child performer under the age of 18 BEFORE the employment begins. The certificate is valid for one year or until the specific project is completed, whichever time period is shorter. Why was this letter sent to me?

This letter was sent to you because there were Unemployment Insurance benefits that were overpaid to you which you need to repay to the department. This letter serves as a statement showing you the balance of those overpaid benefits and the amount that is currently due.

What does this letter mean?

If you are receiving this letter, it means that you currently have an outstanding balance due to NMDWS for Unemployment Insurance benefits overpaid to you. This letter informs you of the total overpayment balance, any interest/fees/penalties accrued, any new overpayments, and any adjustments and/or payments you may have made as of the date of the letter.

What do I do next?

You should submit your payment to NMDWS along with the payment voucher included with the letter to ensure your payment is processed promptly. When making your payment, do not send cash. Mail a check or money order to the address provided in the letter. You can also make a payment online by logging in to your Unemployment Insurance Tax & Claims System account at www.jobs.state.nm.us.

Where am I in the claims or tax process?

You are in the claims collection process until your overpayment balance is paid in full.

Who should I contact if I have any questions?

You can contact a Customer Service Agent in the Unemployment Insurance Operations Center at 1-877-664-6984, Monday through Friday from 8:00 a.m. to 4:30 p.m. English and Spanish-speaking Customer Service Agents are available to assist you.

You can also access claims information online at www.jobs.state.nm.us. All individuals receiving Unemployment Insurance (UI) benefits are required to log into the New Mexico Workforce Connection Online System (www.jobs.state.nm.us) first in order to access the UI Tax & Claims System. UI claimants are required to maintain usernames and passwords for both the online jobs system (www.jobs.state.nm.us) and the UI Tax & Claims System.
